Know Your Rights: Landlords Cannot Restrict These Tenant Rights

In an era marked by increasing disputes between landlords and tenants, it’s crucial to understand the legal boundaries that landlords cannot cross. Despite what rental agreements may stipulate, there are certain rights tenants possess that landlords cannot restrict.

Eduarda Hekšová, director of the consumer organization dTest, highlights one common illegal clause found in rental contracts: the prohibition of keeping pets. Contrary to such clauses, the Civil Code explicitly permits tenants to have animals in their apartments, provided they do not cause disproportionate inconvenience within the property.

Moreover, landlords cannot prohibit tenants from having visitors or impose mandatory reporting of visits. Whether it’s friends or family staying over, tenants have the right to host guests without interference from the landlord.

Disputes over permanent residence are also prevalent. While landlords may require notification of increased occupancy within two months, they cannot withhold consent for close relatives such as spouses, parents, or children to move in.

Additionally, attempts to prohibit tenants from registering a permanent residence in the rented apartment are legally untenable. Tenants have the right to register their permanent residence without needing the landlord’s consent, as long as they have a valid lease agreement.

It’s essential for tenants to be aware of their rights to ensure fair and lawful treatment in their rental agreements. Understanding these rights can empower tenants to assert themselves and address any unjust restrictions imposed by landlords. By upholding these legal principles, both landlords and tenants can foster harmonious and mutually respectful living arrangements.
