According to experts from the Czech consumer organization dTest, it’s crucial to research and determine whether you’re purchasing from a business operator during their business hours or a private individual on one of these platforms because your protection rights differ.
If you buy second-hand goods from a business operator, you are entitled to the same rights as if the goods were new. For instance, your complaint must be resolved within 30 days. By law, business operators must also provide you with additional information such as the item’s condition, including any defects or degree of wear and tear.
It’s important to pay attention to the condition of the goods and, for electronics, to ensure that all functions work properly. You can document the condition when you receive the item, which can help avoid future issues. Eduarda Hekšová, the director of the consumer organization dTest, recommended being proactive in such situations.
Business operators are allowed to shorten the time for exercising rights for defective performance, but only up to 12 months. It’s important to be cautious when negotiating a shorter time for exercising your rights.
If you purchase second-hand goods from a private seller, you may encounter various delays when making a complaint. There is no 30-day period for resolving complaints in this case. While private sellers can be held responsible for defects, they may intentionally delay repairing them, making it more challenging to enforce your rights. Hekšová warned that you might need to defend yourself in court in such cases.
