Czech Government Takes Action to Enhance Protection for Domestic Violence Victims
In a significant development, the Czech government has introduced a clear and comprehensive definition of domestic violence that will come into effect in the middle of next year. The primary objective of this move is to provide better protection for victims of domestic abuse. Currently, although the term “domestic violence” is mentioned in eight key laws, none of them provides a specific definition. Disturbingly, recent data from 2022 indicates that nearly 30% of women and 12% of men in the Czech Republic have experienced domestic violence, with their partners being the main perpetrators.
The new definition, incorporated into the civil code, establishes domestic violence as acts committed against a victim that illegitimately affect or may affect their physical or mental well-being, freedom, dignity (especially in the sexual context), gravity, honor, privacy, or that seriously endanger their ability to fulfill their own needs or the needs of other household members. It also encompasses the abuse of power or an unequal position. The definition includes not only individuals living with or in the same household as the perpetrator but also close relatives and former partners.
By introducing this clear definition, the government aims to enhance the protection afforded to victims of domestic violence. Currently, the majority of cases go unreported in the Czech Republic, with only one in five severe incidents being brought to the attention of authorities, according to government estimates. Therefore, experts and politicians anticipate that a unified definition of domestic violence will facilitate the provision of more effective assistance to victims.
The lack of a specific definition has posed significant challenges for organizations that provide support and care for victims of domestic abuse. Authorities and professionals involved in managing such cases often interpret the term differently, resulting in inconsistencies in providing practical assistance to victims. The introduction of a clear definition is expected to address these challenges and enable the system to offer comprehensive protection to all victims from the outset. This proactive approach is vital in preventing the escalation of violence and its potentially severe consequences.
Branislava Marvánová Vargová, a representative from the women’s center ROSA, emphasized the importance of providing early protection for all victims and preventing the escalation of violence and its devastating effects. Disturbing statistics indicate an increasing number of murders driven by personal conflicts. Hence, it is crucial to tackle domestic violence proactively and prevent it from reaching severe and tragic outcomes.
